THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.28640 of 2017 O R D E R:

Petitioner filed this Writ Petition challenging the inaction of the respondents 1 to 4 in registering FIR pursuant to a complaint made by the petitioner on 03.06.2017 on the ground that the 6th respondent, who was working as Dy. Tahsildar, had tampered the Adangal Record by putting his digital signature on 16.05.2017, which was not there previously.

It is not disputed by the counsel for petitioner that it is the duty of the Tahsildar to sign the digital pahani and when an officer is performing his official duty, he cannot be said to be tampering the record rendering himself liable for prosecution.

If the petitioner has any grievance on account of the action of the 6th respondent in signing the pahani and mutating somebody else's name, petitioner has a remedy under the provisions of the A.P. Rights in Land and Pattadar Pass Book Act, 1971 and also in the Civil Court. 4.

Since the action of the petitioner appears to be a coercive tactic on the 6th respondent and prima facie the conduct of the 6th respondent does not appear to be of a

criminal nature and is admittedly part of his official duty, petitioner is not entitled to any relief in this Writ Petition. 5.

Therefore, this Writ Petition is dismissed at the admission stage. There shall be no order as to costs. 6.

Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
