HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38387 of 2016 ORDER:

The present writ petition is filed by the petitioners seeking to call for the records relating to CC No.137 of 2016, on the file of the Judicial Magistrate of First Class, Bodhan, Nizamabad District, and quash the same.

After arguing for some time, learned counsel for the petitioners sought permission of this Court to withdraw the writ petition and requested to permit the petitioners to approach the Court below by way of filing a discharge application.

Permission is accorded and accordingly, the Writ Petition is dismissed as withdrawn. However, in view of the request of the learned counsel for the petitioners, liberty is given to the petitioners to file a discharge application before the Court below, and on such application being filed, the Court below shall consider the same in accordance with law.

No order as to costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
