This Writ Petition, under Article 226 of the Constitution of India, is filed seeking the following relief: "to pass an order or direction or writ, particularly in the nature of mandamus duly declaring the action of the 2nd respondent herein in not according the permission, and seeking link documents prior to 2015 on his application vide 308/W11/2019/7583(24.06.2019) in respect of plot number 16 in survey number 94/1 of Pakabanda Khammam, as illegal, arbitrary and principles of natural justice and consequently direct the respondent to accord the permission forthwith on the above application in the interest of justice."

Heard the learned counsel for the petitioner and the learned Standing Counsel for 2nd respondent-Municipality. 3.

The only grievance of the petitioner is that despite furnishing the documents before the respondent authorities for according permission for construction of residential house in the subject plot, again repeatedly, the respondents are asking to submit the documents.

Having regard to the same, and considering the facts and circumstances of the case, without expressing any opinion on the merits of the case, the Writ Petition is disposed of directing the petitioner to furnish the documents relating to the subject property before the respondent authorities under proper acknowledgment and on such submission, the respondent authorities shall consider the application of the petitioner for building permission, if the same is in order, in accordance with law.
