O R D E R

The prayer of the petitioner in this case was to direct the police authorities not to call him to the police station or compel him to sign in the police station as a routine duty and not to interfere with his life and liberty.

By order dated 28.04.2011, this Court took note of the fact that the petitioner was contesting for the Pulivendula Assembly election, which was scheduled to be held on 08.05.2011 and that his complaint was that he was being called to the police station every day which interfered with his canvassing for the election and accordingly directed the police authorities not to interfere with his personal life and liberty or call him to the police station.

Though no counter-affidavit has been filed by the respondents, the averments made in the writ affidavit confirm that the grievance of the petitioner was in the context of the Assembly election in which he was contesting at that point of time. Needless to state, in the event the police authorities deem it necessary to summon the petitioner in the context of any crime registered against him or for investigation of any other crime in which he may be a material witness, they are bound to follow the due procedure laid down by law. With the above observation, the writ petition is closed. Pending miscellaneous petitions, if any, shall also stand closed. No order to costs. ______________________ SANJAY KUMAR, J 3rd JUNE, 2015 PGS
