HON'BLE SMT. JUSTICE LALITHA KANNEGANTI CRIMINAL PETITION No. 9239 of 2021 O R D E R:

This petition is filed under Section 438 Cr.P.C. seeking bail to petitioners/A-1 and A2 in the event of their arrest in connection with Crime No.2089 of 2021 of Rajendranagar Police Station, Cyberabad District, registered for the offence punishable under Section 306 read with 34 IPC. 2.

The case of the prosecution is that there were family disputes between the son of de-facto complainant i.e., deceased- Mr. O. Chandrashekar Rao, and his wife-A1 and his brother-in-law-A2, and that on 12.10.2021 at 20.30 hours, A2 called the deceased to Bandlaguda Jagir, and after reaching home, A1 and A2 have scolded him and tried to beat him, due to which, he committed suicide on 13.10.2021 at 16.00 hours. The de-facto complainant found a selfie video of the deceased stating that A1 and A2 were constantly harassed him.

Learned counsel for petitioners Sri P. Sriharinath, submits that petitioners/A1 and A2 are wife and brother-in-law of the deceased, and there were family disputes between the deceased and A1, and A2 also used to interfere with the said disputes, and before the incident, a dispute has taken place between the deceased and the accused and after that, he committed suicide and he has taken a selfie video, wherein he stated that A1 and A2 were harassing him both physically and mentally, as such, he committed suicide. Learned counsel submits that the deceased was doing online trading business and he has incurred heavy loss and he is not mentally balanced and committed suicide. He submits that the 1st petitioner being wife has no reason to instigate or abet him to commit suicide and it is only a common difference of opinion between the wife and husband and that the petitioners have not committed the alleged offence and hence, their case may be considered for grant of pre-arrest bail.

Learned Assistant Public Prosecutor submits that investigation is pending, and basing on the selfie video taken by the deceased, Section of law is altered as 306 IPC and the crime is registered under Section 306 IPC. 5.

Looking at the allegations in the complaint and the strained relationship between the parties and the difference of opinion with regard to financial matters between them, this Court deems it appropriate to grant prearrest bail to petitioners. 6.

The Criminal Petition is allowed. Petitioners - Accused Nos.1 and 2 shall surrender before the Station House Officer, Rajendranagar Police Station, Cyberabad District, in connection with Crime No.2089 of 2021 within one week from today and on such surrender and executing a personal bond for Rs.20,000/- (Rupees twenty thousand only) each with two sureties for a like sum each to the satisfaction of the said Station House Officer, they shall be released on bail. It is made clear that no further extension of time will be granted.
