THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI CRIMINAL PETITION No.5516 of 2017 ORDER:

This Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973, is filed by the petitioners/A2 to A7 in C.C.No.401 of 2016 on the file of the Court of the learned Judicial Magistrate of First Class, Medak, requesting to quash the proceedings against them in the said case.

I have heard the submissions of the learned counsel for the petitioners/A2 to A7 and of the learned Public Prosecutor representing the State of Andhra Pradesh.

The aforestated case is taken on file pursuant to the final report filed against the petitioners/accused for the offences punishable under Sections 498-A IPC and Sections 3 and 4 of Dowry Prohibition Act. After making submissions for some time, the learned counsel for the petitioners/A2 to A7 submitted that the petitioners may be permitted to confine the relief to the limited extent of dispensing with their appearance in the above proceedings before the trial Court on the date of each and every adjournment. He further sought liberty to the petitioners/A2 to A7 to file appropriate applications, which the law permits, before the trial Court.

In view of the afore-said submissions, there is no need to advert to the merits of the matter and record any findings which will have a bearing on the merits of the matter. Hence, this Court is of the view that the criminal petition can be disposed of with appropriate directions.

Accordingly, the Criminal Petition is disposed of dispensing with the presence of the petitioners/A2 to A7 in C.C.No.401 of 2016 on the file of the Court of the learned Judicial Magistrate of First Class, Medak, on each and every day of adjournment; however, subject to the condition that they shall appear as and when directed by the learned Magistrate and whenever their presence is necessary in the above said case. Liberty as sought for by the petitioners is also reserved. Needless to state that any petitions, which the petitioners/accused may file, shall be disposed of on their own merit and in strict accordance with the procedure established by law.
