This Writ Petition, under Article 226 of the Constitution of India, is filed seeking the following relief: "to issue Writ, Order or Direction one more particularly in the nature of Writ of Mandamus declaring the action of the respondents in not considering for grant of building permission for construction of residential building in Open Plot No.490 in an extent of 266.66 square Yards in Sy.No.674/1 situated at AN Reddy Colony, Shastrinagar, Nirmal Mandal, Nirmal District, as the same does not come under cut-off date of Layout Regularization Scheme, 2015 as per GO Ms No.151 dated 02.11.2015 as arbitrary, illegal, unconstitutional and contrary to the Municipalities Act and consequently direct the 2nd respondent to grant building permission for construction of residential building in Plot No.490 in an extent of 266.66 square Yards in Sy.No.674/1 situated at AN Reddy Colony, Shastrinagar Nirmal Mandal, Nirmal District."

When the matter is taken up for hearing, learned counsel for the petitioner as well as learned Standing Counsel for the 2nd respondent-Municipality would submit that the issue involved in this writ petition is squarely covered by the order of this Court, dated 20.02.2018, in W.P.No.3240 of 2018.

Having regard to the submission made by both the counsel and following the said order, this Writ Petition is also disposed of directing the 2nd respondent to consider the petitioner's grievance for grant of building permission for construction of residential building in the aforementioned property, subject to fulfillment of the requirement criteria on own merits, within a period of four (4) weeks from the date of receipt of a copy of this order.
