THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.11054 of 2025 ORDER:

Seeking the Court to enlarge the petitioner who is arrayed as accused No.2 in Crime No.01 of 2025 of Economic Offences Wing, Cyberabad Commissionerate, on bail, the present Criminal Petition is filed.

The brief facts of the case are that accused No.1 induced the de-facto complainant and others to invest large sums in the names of "Rytal Pharma," "YATI B4 World Class Hospitality OPC Pvt. Ltd.," and "B4 Black Swan World Class Business Technologies OPC," assuring them of monthly returns. The complainant claimed to have invested about Rs.95,00,000/- along with others through bank transfers and cash, based on MOUs executed by A1. The case of the prosecution was mainly against accused No.1, who acted as the mastermind, collected deposits, executed MOUs, diverted funds, and later absconded in November 2024. The petitioner was arrested on 28.07.2025, remanded to judicial custody on

29.07.2025, and was in police custody from 18.08.2025 to 21.08.2025 for interrogation.

Heard Sri P. Vikas Raj, learned counsel appearing on behalf of the petitioner as well as Sri D. Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that the petitioner was falsely implicated as accused No.2 only because of his acquaintance with accused No.1 and some incidental transactions and that he neither solicited investments, nor executed agreements, nor collected funds from the complainant or others. The investigation against the petitioner was completed, and no further recovery or custodial interrogation was required. He stated that the petitioner was a permanent resident of Hyderabad with family and business, had deep roots in society, and was not a flight risk. He further submitted that he was suffering from Type-2 Diabetes Mellitus with Acute Kidney Injury, which required continuous medical care that could not be adequately provided in prison.

Therefore, he prayed the Court to grant bail to the petitioner by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the same stating that the allegations leveled against the petitioner are serious in nature. He further submitted that the investigation was not yet completed. At this stage, granting of bail to the petitioner does not arise. Therefore, he prayed the Court to dismiss the criminal petition. 6.

In light of the submissions made by both learned counsel and upon a perusal of the material available on record, it appears that the petitioner was arrayed as accused No.2 and has been in jail since 28.07.2025. The record further shows that the petitioner is suffering from Type-2 Diabetes Mellitus with Acute Kidney Injury. It is also noted that the material part of the investigation has been completed and 20 witnesses have already been examined. Considering the facts and circumstances of the case, the health condition of the petitioner, and the period of his incarceration, this Court deems it fit to grant bail to the petitioner, subject to the following conditions:

i.

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the learned Principal Junior Civil Judge-cumMetropolitan Magistrate, Ranga Reddy District at L.B. Nagar.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
