THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO WRIT PETITION No.19855 OF 2017 ORDER:

This writ petition is filed, under Article 226 of the Constitution of India, for the following relief: "to issue a writ or more in the nature of a Writ of Mandamus or any other appropriate writ order or directions to direct the Respondent Nos.2 and 3 not to disburse the compensation amounts to respondent no.4 and 5 till disposal of ROR appeal in case No.C/2654/2006 in respect of agricultural lands in sy.No.28/A to an extent of Ac. 2.00 gts., in sy.No.29/E Ac. 1.13 guntas, in sy.no.73/A to an extent of Ac. 3.19 gts, in sy.No.74/A to an extent Ac. 2.30 gts., in sy.no.52 to an extent of Ac. 3.32 gts total land adm. Ac.13.34 gts situated at Pocharam Village, Kukunoor Mandal, West Godavari District, A.P and consequently declare the action of Respondent nos.2 & 3 in not considering the petitioner representations for objections and claims in the subject matter is improper, arbitrary against to the principles of natural justice."

Heard learned counsel for the petitioner and also the learned Government Pleader for Land Acquisition, representing for the respondents 1 to 3 and Sri M.Rajamalla Reddy, learned counsel for the unofficial respondents 4 and 5 and perused the prayer in the writ petition with supporting affidavit and the written instructions received by the learned Government Pleader submitted and also the previous order in

W.P.No.17550 of 2017, dated 05.06.2017, filed by three other petitioners with same surname of the petitioner. 3.

It is the submission of the learned Government Pleader that so far as the present writ petition lands in question, there is no representation and nobody come forward to make any claim and award is passed and no amount for the land in question paid to anybody.

Having regard to the above, the writ petitioner can put forth his grievance with supporting material by filing documentary proof of entitlement to compensation if any within one week from the date of receipt of a copy of this order and the respondents shall consider if able to decide else to refer to competent Court for determination and to deposit the amount therein pending adjudication and meantime not to disburse compensation.

Accordingly and with the above direction, this writ petition is disposed of. Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. No order as to costs.
