THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No.20811 of 2015 ORDER:

The petitioner was appointed as fair price shop dealer of shop No.3 of Atchampeta Village and Mandal, Mahabubnagar District, in the year 2007. While so, the shop was inspected on 25.02.2015 when the petitioner was suffering from fever. A show cause notice was issued to the petitioner on 08.04.2015 in respect of variations noticed in the stocks. The petitioner submitted her explanation on 17.04.2015 in respect of variations. Proceedings u/s.6-A of Essential Commodities Act are pending. When the stocks were not supplied to the petitioner, the present writ petition is filed.

When this matter came up for hearing on 08.07.2015, it was adjourned in order to enable the learned Government Pleader for Civil Supplies to get instructions.

Now, the learned Government Pleader submits that the authorization of the petitioner was not suspended. In the circumstances, the petitioner is entitled to receive the stocks so long as her authorization is in force. Accordingly, the writ petition is disposed of directing the respondents 3 & 4 to supply the stocks to the petitioner so long as her authorization is in force.
