HON'BLE SMT. JUSTICE LALITHA KANNEGANTI CRIMINAL PETITION No. 9241 of 2021 O R D E R:

This petition is filed under Section 438 Cr.P.C. seeking bail to petitioners/A-5 and A-7 in the event of their arrest in connection with Crime No.111 of 2021 of Vangoor Police Station, Nagarkurnool District, registered for the offence punishable under Section 306 read with 34 IPC. 2.

The case of the prosecution is that on 26.08.2021 at 11.30 hours, when the father of de-facto complainant and others were keeping the stones for construction of house in the disputed land, the accused quarreled with them stating that the said open place belongs to them and abused them in filthy language. They also caught hold of his father's collar and beat him with hands by abusing him in filthy language, and on 29.08.2021 at 6.00 hours, his father committed suicide by hanging.

Learned counsel for petitioners Ms. Kodari Anjamma, submits that except mentioning the names of petitioners in the complaint, there are no specific overt acts against them. Learned counsel submits that A1 to A3 were released on regular bail and the names of A4 and A5 were deleted from the array of accused and A8 was granted anticipatory bail by the Court below. Learned counsel submits that as there are no specific allegations against the petitioners, their case may be considered for grant of pre-arrest bail.

Learned Assistant Public Prosecutor submits that investigation is pending and 13 witnesses were examined.

Taking into consideration the fact that in the complaint, though the names of the petitioners are mentioned, there are no specific overt acts against them and further, A1 to A3 were granted regular bail and A8 was granted pre-arrest bail, this Court deems it appropriate to grant pre-arrest bail to petitioners.

The Criminal Petition is allowed. Petitioners - Accused Nos.5 and 7 shall surrender before the Station House Officer, Vangoor Police Station, Nagarkurnool District, in connection with Crime No.111 of 2021 of Vangoor Police Station, Nagarkurnool District, within one week from today and on such surrender and executing a personal bond for Rs.20,000/- (Rupees twenty thousand only) each with two sureties for a like sum each to the satisfaction of the said Station House Officer, they shall be released on bail.
