HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.8658 of 2017 ORDER:

This criminal petition is filed, by the petitioners-accused Nos.2 and 3, under Section 438 Cr.P.C., seeking pre-arrest bail in Crime No.178 of 2017 on the file of Station House Officer, Shadnagar Police Station, Cyberabad District, registered for the offences punishable under Sections 498-A and 306 IPC.

Learned counsel for the petitioners submitted that the petitioners were falsely implicated in this case. The learned Additional Public Prosecutor submitted that the allegations made in the complaint prima facie constitute the offence alleged to have been committed by the petitioners. 3.

A perusal of the record reveals that the petitioners herein along with other accused filed Crl.P.No.3759 of 2017 and the same was dismissed by this Court on 10.07.2017 so far as the petitioners are concerned. Again the petitioners filed Crl.P.No.6423 of 2017 and the same was also dismissed by this Court on 28.08.2017 on the ground that the investigation is in progress.

Learned Additional Public Prosecutor submitted that the investigation is still in progress. A perusal of the record

reveals that there are no changed circumstances from the date of dismissal of earlier two bail petitions to till date. 5.

Taking into consideration the gravity of the offence alleged to have been committed by the petitioners and the stage of the investigation, this Court is of the considered view that it is not a fit case to grant pre-arrest bail to the petitioners.
