THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.7910 of 2005 ORDER:

This writ petition is filed under Article 226 of the Constitution of India to issue a writ of certiorari challenging the order dated 02.9.2004 in M.P. No.3 of 2003 on the file of Labour Court-II, Hyderabad.

2. This court passed the following conditional order on 30.12.2010: Learned counsel for the petitioner is permitted to take out personal notice to respondent No.1 by registered post with acknowledgement due and file proof of service within six weeks. If for any reason, the notice is not served, the same shall be brought to the notice of the Registry without fail. In default, the writ petition stands dismissed as against respondent No.1 without reference to the Court.

3. In spite of the specific direction of this court, the petitioner did not serve the notice on respondent No.1. Therefore, the writ petition against respondent No.1, who is the contesting party, was dismissed for noncompliance of the order dated 30.12.2010. When the writ petition was dismissed against the contesting party, nothing remains against the respondent No.2 to adjudicate in this writ petition.

4. Hence, the writ petition is closed. Miscellaneous petitions if any pending in this writ petition shall stand closed. __________________________ (T.SUNIL CHOWDARY, J) June 10, 2016.
