Heard learned counsel for the petitioner and learned Government Pleader for Revenue for the respondents. 2.

Petitioner alleges that land to an extent of Acs.9.20 guntas in Survey No.717 of Kamepally Village and Mandal, Khammam District, belongs to her mother, Maddineni Kamalamma.

Petitioner, her brother and her sister are the legal heirs of their late mother. She alleges that the subject land was originally purchased by her two brothers, Maddineni Basavaiah and Maddineni Satyam, on 22.01.1963, by paying a valuable sale consideration. Petitioner claims to have applied for issuance of pattadar passbook and title deeds. Earlier, petitioner, along with two others, filed W.P.No.45341 of 2016 praying to declare the action of the Tahsildar in not considering the representation seeking mutation of their names in the revenue records, as illegal. When the matter was taken up for consideration, it was represented that there was total inaction on the part of the Tahsildar in issuing pattadar passbooks and title deeds to the petitioners and others. Learned Government Pleader for Revenue raised objection on the claim of the petitioner stating that no application in Form VI-A was filed by the petitioner. Having regard to this objection, the Writ Petition was disposed of granting liberty to the petitioner to make an application in Form VI-A. 3.

It appears, so far no such application, as required, is filed by the petitioner. The filled in Form VI-A in physical form dated

- 3 - 23.09.2019 is enclosed as Ex.P1 at page No.10 of the writ petition material paper book.

This Writ Petition is filed claiming that the application made by the petitioner in Form VI-A seeking issuance of new pattadar passbook and title deeds is not considered by the Tahsildar. Apparently, so far the name of the petitioner is not mutated in the revenue records and the petitioner has not made application in prescribed form through online web portal seeking mutation of her name in the revenue records. Unless the name of the petitioner is mutated in the revenue records, she cannot be issued pattadar passbook.

Therefore, once again the petitioner is granted liberty to make an application in Form VI-A through online web portal seeking mutation of her name in the revenue records and on receiving such application, the Tahsildar shall consider the same in accordance with law.
