HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37640 of 2016 ORDER:
The present writ petition is filed by the petitioner under Article 226 of the Constitution of India, seeking to declare the action of the respondents in not conducting investigation in Crime No.163 of 2014 of Durgi Police Station, Guntur District, as illegal and arbitrary, and consequently, direct the 2nd respondent to conduct investigation in the above crime.
Heard and perused the material available on record. The main grievance of the petitioner is that on the basis of the complaint filed by him before the 2nd respondent, a case in Crime No.163 of 2014 was registered against the accused, who took an amount of Rs.4,00,000/ - from the petitioner and not repay the same though the petitioner made repeated requests. But the 2nd respondent did not choose to conduct investigation.
Considering the facts and circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, the 2nd respondent is directed to conduct investigation in the above crime, complete the same and file a final report, as expeditiously as possible.
With the above direction, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
