THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.24352 of 2018 ORDER:
Heard learned counsel for the petitioner and the learned Government Pleader for Excise, apart from perusing the material on record.
On the application made by the petitioner herein for interim custody of the subject vehicle bearing No.TS 07 FP 3439, which is a Pulsar bike, seized in connection with Cr.No.B1/88/2018, the Deputy Commissioner of Prohibition and Excise, Mahabubnagar Division-second respondent herein called for Valuation Certificate of the subject vehicle from the concerned Motor Vehicles Inspector, vide proceedings in Cr.No.B1/88/2018, dated 27.03.2018. It is stated in the affidavit, filed in support of the Writ Petition, that the Motor Vehicles Inspector has given the report that the subject vehicle is worth Rs.70,000/-.
In the above background, the grievance of the petitioner herein is that, despite receipt of the said report, the second respondent is not passing any orders on the application made by the petitioner herein.
Having heard the learned counsel for the petitioner and the learned Government Pleader, this Court deems it appropriate to dispose of the Writ Petition, with a direction to the second respondent to pass appropriate orders on the application, dated 12.03.2018, said to have been submitted by the petitioner herein, for release of the subject vehicle, in
accordance with law, within a period of three weeks from the date of receipt of a copy of this order.
Accordingly, Writ Petition is disposed of. There shall be no order as to costs.
Miscellaneous petitions pending, if any, shall stand closed.
