THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY C.R.P.No.4454 of 2017 ORDER:

This revision petition is filed under Article 227 of the Constitution of India assailing the order dated 17.02.2017 passed in I.A.No.1596 of 2016 in O.S.No.80 of 2013 on the file of the Court of IV Additional District Judge, Kadapa. 2.

At the time of arguments, learned counsel for the respondents submitted that the respondents are not pressing I.A.No.1596 of 2016.

In view of the submission made by the learned counsel for the respondents, the order passed by the trial Court is liable to be set aside. In view of the submission made by the learned counsel for the respondents, this Court is not inclined to go into the merits of the main case.

Having regard to the facts and circumstances of the case, the revision petition is allowed setting aside the order dated 17.02.2017 passed in I.A.No.1596 of 2016 in O.S.No.80 of 2013 on the file of the Court of IV Additional District Judge, Kadapa. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
