HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.7542 OF 2015 ORDER :
This writ petition is filed against the proceedings of 2nd respondent dated 28.02.2015, wherein the cheque power of the Sarpanch of Marthidi Grampanchayath has been withdrawn on the ground of certain irregularities.
Heard learned counsel for the petitioner as well as learned Government Pleader for Panchayat Raj.
Learned Government Pleader for Panchayat Raj states that the petitioner has an effective alternative remedy of appeal under Rule 42
(2) of the Rules contained in G.O.Ms.No.30, dated 20.01.1995. In that view of the matter, it is for the petitioner to avail alternative remedy of appeal before the appellate authority and as and when petitioner elects to avail the alternative remedy, as contemplated in G.O.Ms.No.30, dated 20.01.1995, the appellate authority concerned shall consider the same and pass appropriate orders in accordance with law.
