ORDER
This writ petition is filed seeking the following relief: "to issue writ, order or direction, one more particularly in the nature of writ of Mandamus to command and declare the inaction of the respondents in not taking any action in not protecting the Wakf properties as arbitrary, bad in law, spurious, illegal, violating provisions of Wakf Act, 1995 and Articles 29, 26 (a)(b)(c) and (d) and 300-A of the Constitution of India.
Heard learned counsel on either side.
Learned counsel appearing for the petitioner contended that the respondents are not taking any steps to protect the wakf lands admeasuring Ac.5.13 guntas in Sy.No.373/1 and Ac.1.05 guntas in Sy.No.373/1, total Ac.6-18 guntas situated at Moula Ali Village, Malkajgiri District. It is prayed that appropriate orders be passed in the writ petition directing the respondents to take steps to protect the aforesaid wakf lands. Learned Standing Counsel appearing for the respondents contended that if the petitioner submits a representation afresh to the respondents, the respondents would consider the same and pass appropriate orders, in accordance with law.
Having considered the rival submissions made by the learned counsel on either side, this Court is of the considered
view that this writ petition can be disposed of directing the petitioner to submit a representation afresh to the respondents seeking to take effective measures in protecting the aforesaid wakf land within a period of two weeks from the date of receipt of a copy of this order. On receipt of such representation, the respondents shall consider the same and pass appropriate orders in accordance with law. Accordingly, the Writ Petition is disposed of. No costs. Miscellaneous petitions, if any, pending shall stand closed.
