THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 9963 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioner/A5 seeking bail in the event of his arrest in connection with Crime No.194 of 2023, on the file of Dammapet Police Station, Bhadradri, Kothagudem District, for the offences punishable under Sections 143, 147, 448, 324, 294-B, 354, 506 r/w.149 of the Indian Penal Code.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record. 3.

The case of the defacto complainant is that this petitioner and five others have attacked her husband.

Since no specific overtacts are attributed to this petitioner and it is alleged that he was part of the group who attacked the victim, this Court deems it appropriate to grant Anticipatory Bail to this petitioner. 5.

Accordingly, the Criminal Petition is allowed granting Anticipatory bail to the petitioner/A5, subject to the following conditions:

1) The petitioner/A5 is directed to surrender before the Station House Officer, Dammapet Police Station, Bhadradri Kothagudem District, on or before 19.10.2023. On such surrender, the said Station House Officer shall release the petitioner/A5 on bail, on his executing personal bond for a

sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioner/A5 shall appear before the concerned police on every Monday between 10.00 a.m. to 1.00 p.m. for a period of eight weeks, for the purpose of investigation.

3) The petitioner/A5 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
