THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.17795 OF 2016 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for Home. With consent of the counsel appearing for both sides, the present writ petition is disposed of at the admission stage.

2. The present Writ Petition is filed seeking issuance of writ of mandamus declaring the action of the 3rd respondent in forcing the petitioner and other plaintiffs in O.S.No.107 of 2016 on the file of the Principal Junior Civil Judge, Medchal, Ranga Reddy District to have a settlement with the unofficial respondents herein, not withstanding the fact of pendency of the above civil case and obtaining injunction order dated 22.04.2016 in I.A.No.435 of 2016 and in threatening the petitioner and other plaintiffs in the above suit that various criminal cases would be registered against them, if they do not heed the warnings, as illegal and arbitrary and consequently, to direct the respondents 1 to 3 not to call the petitioner and not to force him to settle the issue with the unofficial respondents.

3. Since this Court is not going into merits of the case, it may not be necessary to issue notice to the unofficial respondents.

4. The petitioner along with others filed O.S.No.107 of 2016 on the file of the Principal Junior Civil Judge, Medchal, Ranga Reddy District against the unofficial respondents seeking injunction. By an order dated 22.04.2016 in I.A.No.435 of 2016 the trial Court passed injunction order in favour of the petitioner and other plaintiffs. It is said that in spite of obtaining injunction orders and

even after showing the same, the unofficial respondents herein are making efforts to harass the petitioner. Respondents 2 and 3 in collusion with others are harassing the petitioner by summoning him to the police station unlawfully.

5. Learned Government Pleader for Home submits that the allegations made in the affidavit filed in support of the writ petition are all false. It is said that the petitioner himself lodged a report on 03.05.2016 and in view of the same, he is being summoned to the police station to enquire into the allegations made by him.

6. Without going into the merits of the case, the Writ Petition is disposed of directing the respondents-police to be mindful of the limits of their jurisdiction in criminal law and not to interfere with any civil dispute and not to summon the petitioner to the police station except in accordance with law.

Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
