HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.14065 of 2015 ORDER:
This Writ Petition is filed for a Mandamus to declare the revised list of detained candidates, dated 27.04.2015, issued by respondent No.1, whereby the petitioner was detained on the ground of shortage of attendance, as illegal and consequently, to direct the respondents to permit the petitioner to write the main examinations as well as the supplementary examinations of B.Tech (Metallurgy).
It is the case of the petitioner that he was admitted into II semester of III year B.Tech (Metallurgy) course on 20.01.2015. He averred that if his attendance is taken into account from 20.01.2015, he fulfills the minimum attendance criteria, but the respondents calculated the same from 29.12.2014 and are not allowing him to write the examinations.
Heard learned counsel for the petitioner.
Learned Standing Counsel for respondent No.1 submits that as per the Regulations of respondent No.1-University, a student should have minimum 75% of attendance to write the examinations and only 10% of attendance can be condoned on medical grounds and not beyond that.
In view of the same, it is open for the petitioner to make a representation to respondent No.2, who, in turn, shall consider as to whether the petitioner has the minimum percentage of attendance, to allow him to write the examinations, as per the Regulations of respondent No.1-University and if so, declare the results. Since the petitioner states that examinations already started, he is permitted to write the examinations. However, if respondent No.2 comes to conclusion that the petitioner is not having minimum percentage of attendance as per the Regulations of respondent No.1, the results shall not be declared. Subject to the above observations and directions, the Writ Petition is disposed of.
As a sequel to disposal of the Writ Petition, WPMP.No.18424 of 2015 is disposed of as infructuous.
