HON'BLE SRI JUSTICE T.AMARNATH GOUD W.P.No.27679 of 2019 ORDER:
This Writ Petition is filed to declare the action of the respondents in not including the petitioner-rice mill in the KMS 2019-20 as illegal and arbitrary.
It is indicated in the impugned proceedings dt.28-10-2019 that M/s.Varalakshmi Rice Mill, which was purchased by Sri Nagabandi Ramulu, Proprietor of M/s. Sri Sapthagiri Para Boiled Rice Industries, and the said mill was in arrears. Therefore, it is clear that the petitioner-rice mill has not committed any default in payment of arrears, hence, the petitioner-rice mill cannot be put to any prejudice. In view of the same, the impugned proceedings dt.28-10-2019 are set aside as the same is unilateral. With regard to the inclusion of the name of the petitioner-rice mill in KMS 2019-20, the petitionerrice mill is at liberty to make an application in accordance with law and the same shall be considered by the respondents and appropriate orders would be passed within a period of two weeks from the date of filing of the application by the petitioner.
