THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.1012 of 2016 ORDER:

This petition is filed under Section 482 Cr.P.C. seeking to quash the proceedings against the petitioner/accused No.6 in C.C.No.15 of 2010 on the file of Court of Judicial Magistrate of First Class, Vemulawada, Karimnagar District. Heard the learned counsel for the petitioner and the learned Public Prosecutor, representing the State.

A perusal of the record reveals that Non-bailable Warrant is pending against the petitioner. Learned counsel for the petitioner has sought permission of this Court to permit the petitioner to withdraw the criminal petition with a liberty to avail the remedies available to him under law including filing of petition under Section 70(2) Cr.P.C. to recall the warrant. He further submits that the trail Court may be directed to pass orders on such petition on the same day.

Having regard to the facts and circumstances of the case, the Criminal Petition is dismissed as withdrawn with a liberty to the petitioner to avail all the remedies available to him under law including filing of a petition under Section 70(2) Cr.P.C. to recall the warrant. If the petitioner files the petition under Section 70(2) Cr.P.C., the trial Court is hereby directed to dispose of the same on the same day in accordance with law.

Consequently, Miscellaneous Petitions, if any, pending in this Criminal Petition shall stand closed.
