Heard learned counsel for the petitioner.

The petitioner states that he is a licenced A-Grade Electrical Contractor carrying out electrical installation works upto 11 KV. He was issued licence by the authorities concerned in the year 2013 and it was renewed from time to time and is valid upto 17.11.2017. When the 3rd respondent issued a Notification inviting tenders for providing temporary illumination during Brahmotsavam-2017 and last date for submission of tender schedule was 17.07.2017, the petitioner submitted his tender duly complying with all mandatory requirements. He quoted 18% less than the estimated price. He came to know that the other tenderers quoted only 11% and less. When the tender was not finalized, he filed the present Writ Petition challenging the action of the 3rd respondent.

Now, the 3rd respondent filed counter-affidavit stating that though the petitioner participated in the tender, but he was disqualified in the technical evaluation. The tender was opened on 17.07.2017. The petitioner has not submitted the Registration Certificate in Class-III Electrical, which is a mandatory requirement. But, the petitioner possesses Registration Certificate in respect of Civil Works. Later on, the price bid was opened on 17.07.2017 and one E.Madhavaiah, who quoted 4.9% less than the estimated contract value was declared as preferred bidder. He was invited for negotiations and he accepted to take the work for

-10.50% of the estimated contract value and accordingly, his name was sent for approval to the Commissioner, Endowments Department on 19.07.2017.

A perusal of conditions of tender indicate that one should have Class-III Electrical, A Grade A.P.Electrical Licence Certificate and experience in electrical in the temple. The petitioner did not file such document, but he filed a document stating that he is Class-III Electrical Contractor in Civil works. 5.

In view of disqualification of the petitioner and also keeping the long lapse of time as on today after opening the tender, the Writ Petition cannot be entertained and accordingly, the Writ Petition is dismissed.
