HON'BLE SRI JUSTICE T. VINOD KUMAR WRIT PETITION No.27727 of 2019 ORDER:

This writ petition is filed seeking Mandamus questioning the inaction of the Respondent Nos.2 to 5 in considering the complaint and evidences submitted by the petitioner before the 5th respondent dated 16.03.2017 and not conducting proper investigation in the matter, as arbitrary and illegal and a consequential direction to the authorities to investigate the matter as early as possible and file the charge sheet therein. Heard Sri Lakshmikanth Reddy Desai, learned counsel for the petitioner and the learned Assistant Government Pleader for Home appearing for respondent Nos.1 to 5.

The learned Assistant Government Pleader for Home on written instructions dt.26.12.2019 submits that basing on the complaint of the petitioner, a case in Crime No.274 of 2017 under Section 417, 419, 420 IPC and Section 66 (C & D) of IT Act has been registered and investigated into. He further submits that during the course of investigation, the police authorities found that the amounts of the petitioner were transferred to different e-wallets and on verification of the Axis bank which is connected to wallets, it is learnt that the said account is held in the name of Mr.Sippu Hasnain Khan, Plot No.B-91, Nrayan Niwas, Sector 19, Thane, Maharashtra. On verification, the above mentioned address is found to be false. He further submits that all possible efforts were made to detect the case but as there is no hope of detecting the case, the case

is closed as un-detected and obtained permission from DCP Crimes, Cyberabad, to refer the case as "Un-Detectable"

vide proceeding No.105/CD file/DCPCr/Cyb/2018, dated.16.10.2018.

Having regard to the submissions made by the authorities that despite of their efforts, they could not detect the case, this Court is of the view that no direction can be given in the matter. Accordingly, this writ petition is closed. No order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
