ORDER
This petition under Section 482 Cr.P.C. is filed by the petitioners/A1 to A3 seeking to quash the proceedings in C.C.No.627 of 2015 on the file of VIII Metropolitan Magistrate, Cyberabad, Ranga Reddy District, for the offences punishable under Sections 326, 341, 506 r/w 34 IPC, against them.
2. It is alleged in the charge sheet that on 01.04.2014, when the complainant was travelling from New Delhi to RGI Airport and when he was in the air craft, there was minor verbal argument over the luggage with the two unknown passengers, who sat in 5B and 4E and the same has been pacified with the help of the flight attendant and later, on the same day at about 1525 hours, the complainant landed at RGI Airport, Shamshabad, along with his colleague and both of them boarded in a tax to go to Banjara Hills and on the way, the aforesaid two passengers along with four others have attacked the complainant, beat him with baseball bat, iron rod on his face, head, neck, back and chest and also threatened him with dire consequences and fled away. Based on the complaint, a case in Cr.No.140 of 2014 of RGIA Police Station, Shamshabad, was registered against the petitioners/A1 to A3 for the offences under Sections 326, 341, 506 r/w.34 IPC.
3. Heard and perused the material on record.
4. In view of the serious allegations mentioned in the charge sheet, the matter has to be decided after full fledged trial and therefore, this Court is not inclined to interfere with the impugned proceedings. However, the presence of the petitioners 1 and 3/A1
and A3 except petitioner No.2/A2 before the trial Court is dispensed with except on the dates whenever their presence is insisted by the trial Court and they shall be represented by their counsel.
5. With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
