THE HONOURABLE SRI JUSTICE E.V.VENUGOPAL WRIT PETITION No.24826 of 2018 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India, seeking the following relief:
".....to issue a Writ, Order or direction more particularly one in the nature of Writ of mandamus, declaring the action of the respondent university in not extending the remuneration in par with regularly appointed Assistant Professor/Associated professors in terms of Para 13.1 of UGC Regulations of Minimum Qualifications for appointment of Teachers and other Academic Staff in Universities and Colleges and Measures for the Maintenance of Standards in Higher Education, 2010 and also the decisions of the Supreme Court in State of Karnataka vs. Umadevi ((2006) 4 SCC 1) as recently affirmed in State of Punjab vs Jagjit Singh ((2017) 1 SCC 148), and Ram Naresh Rawat vs. Aswini Ray and others reported in 2017 (3 SCC 436) from the date of their initial engagement and pass such other order or orders." 2.
Mr.Vijay Kumar, learned senior counsel for petitioners submits that the 2nd respondent has withdrawn the writ petition with a liberty to file a fresh writ petition and accordingly filed the writ petition vide W.P.No.41654 of 2022 and accordingly this Court has disposed of the said writ petition on 16.11.2022 with a direction to respondents to dispose of the representation of the 2nd petitioner within four (4) weeks. Hence, seeks this Court's intervention on the similar lines to permit the petitioner Nos.1 and 3 also to make fresh representation to
respondents.

Learned standing counsel for respondent Nos.1, 2 and 4 to 6 expresses no objection to consider the same in accordance with law.

Having regard to the submissions made by both the learned counsels, this Court deems it proper to permit the petitioner Nos.1 and 3 to make fresh representation to the respondents within a period of two (2) weeks from the date of receipt of a copy of this order and on receipt of the same the respondents shall consider and dispose of such representation of petitioner Nos.1 and 3 as expeditiously as possible preferably within a period of six (6) weeks from the date of the representation being made by petitioner Nos.1 and 3 strictly in accordance with law.

Accordingly, the writ petition is disposed of. There shall be no order as to costs.

Miscellaneous application, if any pending, shall stand disposed of.
