THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.8090 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.1 in connection with Crime No.236/2022 on the file of Yacharam Police Station, Ibrahimpatnam, Rachakonda Commissionerate, registered for the offences punishable under Sections 498-A, 306, read with 34 of Indian Penal Code and Sections 3 & 4 of Dowry Prohibition Act. 2.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The case against the petitioner is that he was constantly harassing his wife and unable to bear such harassment his wife committed suicide.

The facts of the case in brief that on 25.05.2012 the marriage of this petitioner and the deceased was performed by giving dowry. Thereafter, this petitioner along with other accused have constantly demanded for additional dowry.

Learned Assistant Public Prosecutor on instructions would submit that investigation is complete and charge sheet is also filed and the other arrested accused were already released on bail. 6.

In the said circumstances, since it is stated that already investigation is complete, this petitioner can be released on bail subject to the following conditions:

i) The petitioner/A1 shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of XXVI Metropolitan Magistrate, Rachakonda at Ibrahimpatnam.

ii) The petitioner/A1, after release shall appear before the concerned Court, on every date of hearing.

iii) The petitioner/A1 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
