THE HON'BLE SRI JUSTICE T.AMARNATH GOUD WRIT PETITION No.27732 of 2019 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, is filed seeking to declare the action of the 2nd respondent in not considering the petitioner's representation, dated 03.10.2019 and not resorting to remove the illegal constructions made over the petitioner's land admeasuring 50 square yards by the 3rd respondent, as arbitrary and illegal and consequently direct the 2nd respondent to cancel the permission accorded and remove the illegal and unauthorized constructions made by the 3rd respondent forthwith.

Heard the learned counsel for the petitioner and the learned Standing Counsel for 2nd respondent-Municipality. 3.
The grievance of the petitioner is that the 3rd respondent, who is none other than his brother, is making illegal constructions by encroaching the petitioner's land. He further submitted that the petitioner made representation on 03.10.2019 to the 2nd respondent with regard to illegal/unauthorized constructions by the 3rd respondent in the petitioner's land, but till today no orders are passed on the said representation.

Having regard to the same and considering the facts and circumstances of the case, the Writ Petition is disposed of directing the 2nd respondent to summon the petitioner as well as 3rd respondent and after affording opportunity to both the parties, the 2nd respondent shall pass appropriate orders on the representation
of the petitioner, dated 03.10.2019, in accordance with law, expeditiously.
