THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.31702 of 2017 ORDER:

Heard learned counsel for the petitioners and Sri N.Venkateshwara Rao, learned Standing counsel for respondent Municipality.

Petitioners claim to be the owners of the properties at Varidhanam Road, Palakol, West Godavari District, within the municipal limits. The grievance of the petitioners in the present writ petition is that without recourse to law the respondent authorities are interfering with the possession and enjoyment of their private properties.

When the matter is taken up, it is submitted by the learned Standing counsel that the respondent authorities will follow due process of law, if the private properties of the petitioners are required for any public purpose.

In view of the above submission of the learned Standing counsel, the writ petition is disposed of, directing the respondent Municipality not to meddle with the private properties of the petitioners, except in accordance with law. It is further made clear that if the properties of the petitioners are required for any public purpose, the respondent authorities shall follow due process of law. No order as to costs.
