THE HONOURABLE SRI JUSTICE T.AMARNATH GOUD W.P.No.27791 of 2019 ORDER:

It is the grievance of the petitioner that the unofficial respondents are making unauthorized construction and also encroaching upon the petitioner's land and when the petitioner brought it to the notice of the official respondents and also made a representation on 14.11.2019, till date, no action has been initiated, and hence, this writ petition.

Heard learned counsel.

Having regard to the facts and circumstances of the case, in order to meet the ends of justice, this Court is of the view to direct the 2nd respondent-Municipal Commissioner, Kyathanpally Municipality to summon the petitioner as well as the unofficial respondents and take necessary action to resolve the matter in accordance with law. Till such time, the persons, who are having authorized permissions, are at liberty to proceed with the construction strictly in terms of their sanctioned plan and if any deviations are found on the subject lands, the official respondents shall initiate action without any delay. The above exercise shall be completed by the end of February, 2020.

With the above observation and direction, the writ petition is disposed of. There shall be no order as to costs. Miscellaneous Petitions, if any, shall stand closed. _______________________ T.AMARNATH GOUD,J Dated 17.12.2019 kvrm
