THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION No.22796 OF 2013 ORDER:
Heard the learned counsel appearing for the petitioner and the learned Government Pleader appearing for the respondents 1 to 5.
The prayer sought for in the writ petition is as under: "to issue a writ of mandamus declaring the action of the respondents 3 to 5 in interfering with civil disputes by trying to dispossess the petitioner from peaceful possession and enjoyment of the property of land admeasuring Ac.3.24 guntas in Sy.No.743AA, situated at Outskirts of Satrajupalli village, Vemulawada Mandal, Karimnagar District at the instance of respondent No.7 in violation of status quo order passed in I.A.No.223 of 2013 in O.S.No.46 of 2013 on the file of I Additional District Judge, Karimnagar as illegal, arbitrary, illegal and unconstitutional and consequently, direct the respondents 3 to 5 not to interfere with the peaceful possession and enjoyment of the property admeasuring Ac.3.24 gts. in Sy.No.743AA, situated at Outskirts of Satrajupalli village, Vemulawada Mandal, Karimangar District."
The main grievance of the petitioner is that the respondent No.5 is interfering in civil disputes between the petitioner and respondent No. 7. The respondent No.5 filed a counter affidavit stating that the petitioner approached the Inspector of Police, Vemulawada on 13.06.2013 and lodged a complaint stating that he owns land admeasuring Ac.3.24 guntas, situated in Sy.No.743AA of Satrajupalli village and there is a dispute with the 7th
respondent. The petitioner approached the competent civil Court and obtained injunction orders in his favour on 04.04.2013. Though a complaint is lodged, since the matter is seized of by a competent civil Court, the 5th respondent has not taken any action. It is also stated in the counter affidavit that since the matter is purely civil in nature, the police have nothing to do with the same. In fact, it is for the petitioner and 7th respondent to settle their personal disputes in the Court of law.
Considering the contents of the counter affidavit that the 5th respondent is not interfering with the civil disputes between the petitioner and 7th respondent, the writ petition is closed. No costs.
