THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.11097 OF 2025 Seeking the Court to enlarge the petitioner who is arrayed as accused in Crime No.741 of 2025 of Raidurgam Police Station, Cyberabad Commissionerate, on bail, the present Criminal Petition is filed. 2.

The brief facts of the case are that the de-facto complainant lodged a report before the police stating that she came into contact with the petitioner in the year 2024 through a mutual friend. From the outset, the petitioner deliberately misrepresented himself as a wealthy and influential individual, falsely claiming associations with reputed institutions such as "Brilliant Grammar School" and frequently arriving in a luxury BMW car to create a false image of affluence and credibility. The de-facto complainant clearly expressed her intention of seeking a serious, marriage-oriented relationship. However, the petitioner forcibly established physical relations with the de-facto complainant on

26.01.2024 when she was in a semi-conscious state. Thereafter, he continued to promise that he would marry her. The petitioner also induced her to facilitate a hand loan of Rs.22,00,000/- to his father, but he neither returned the amount nor married her. As a result, she issued a legal notice to the petitioner on 04.07.2025. He received the same but there was no response. Hence, the complainant lodged a report before the police requesting necessary action. Based on the said complaint, the police registered a case vide Crime No. 741 of 2025 for the offence punishable under Section 69 of the Bharatiya Nyaya Sanhita, 2023 (for short, 'BNS').

Heard Sri S.Someshwar Rao, learned counsel appearing on behalf of the petitioner as well as Sri Arun Kumar Doddla, learned Additional Public Prosecutor appearing on behalf of the respondent - State. 4.

Learned counsel for the petitioner submitted that there are no ingredients attracting the offence under Section 69 of the BNS and it is a consequential

relationship between them. They were in the relationship from the year 2024 and she lodged a report in the year 2025 and the petitioner is innocent of the said offence and he completed MBBS and he appearing NEET-PG Exam on 03.08.2025. The petitioner intends to do PG by appearing web counseling as he secured rank of 55435 in NEET-PG Exam. However, the petitioner has been in jail since 07.08.2025 and the material part the investigation is completed. Therefore, he prayed the Court to grant bail to the petitioner by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating the alleged offence registered against the petitioner is a heinous offence and the investigation is not yet completed and as such he requested the Court to dismiss the Criminal Petition. 6.

In light of the submissions made by both the learned counsel and upon perusal of the material

available on record, it appears that de-facto complainant and the petitioner is in relationship from the year 2024 and as seen from the record there are financial transactions between the petitioner and father of the defacto complainant and the petitioner is in jail since 07.08.2025 and all the material witnesses were already examined. Therefore, this Court deems it fit to grant bail to the petitioner, subject to the following conditions: i.

The petitioner shall execute a personal bond for a sum Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the learned XIII Additional Judicial Magistrate of First Class, at Rajendra Nagar, R.R.District.

ii.

The petitioner shall appear before the SHO concerned at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the

purpose investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
