THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.23863 OF 2009 ORDER:

Learned counsel for the petitioner submits that against amendment of entries in revenue records and issuance of pattadar pass book in favour of 3rd respondent, appeal has been filed before the Revenue Divisional Officer by the petitioner. Learned Assistant Government Pleader also not disputed the same.

In fact para-8 of the counter affidavit states that appeal filed by the petitioner before the Revenue Divisional Officer, Visakhapatnam is pending vide Rc.No.3424/09C, dated 25.08.2009. In view of the same the petitioner cannot pursue two parallel remedies one by way of writ petition and the other by way of appeal. As such, without going into the merits of the case, the writ petition is disposed of directing the 1st respondent-The Revenue Divisional Officer, to dispose of the appeal filed by the petitioner in Rc.No.3424/09C, dated 25.08.2009, in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order, after issuing notice to the 3rd respondent. Till then interim order granted by this Court on 09.11.2009 shall continue. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
