ORDER:
Petitioner is a dealer of Fair Price Shop No.16, Khajipet Village and
Mandal, Y.S.R. District. The said shop is, allegedly, said to have been inspected by respondents 5 and 6 and found variation in the stocks and advised the petitioner to inform the concerned Joint Collector within three days of the panchanama. Petitioner states that she has submitted a detailed explanation dated 19.09.2014. Thereafter, the show cause notice dated 30.09.2014 was issued to the petitioner by the second respondent to appear before the second respondent on 18.10.2014. Petitioner submits that no orders are passed on her explanation dated 19.09.2014 but show cause notice was issued on 30.09.2014. Petitioner also complains that her authorization is valid up to 31.03.2016 and that the stocks are not being supplied to her, though she is prepared to deposit the demand draft for the value of stocks.
2. Learned Assistant Government Pleader states that the second respondent shall pass appropriate orders after considering the explanation of the petitioner.
3. In the circumstances, the second respondent is directed to consider the explanation of the petitioner and pass appropriate orders, preferably, within a period of four (4) weeks from the date of receipt of a copy of this order. In the meanwhile, since the authorization of the petitioner is in force, respondents 3 and 4 shall ensure that the petitioner is supplied essential commodities in terms of the conditions of the license after receiving the demand draft for the commodities.
The writ petition is disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs. _____________________ VILAS V. AFZULPURKAR, J January 28, 2015 DSK
