Anagandula Shankaraiah, S/o. Late A. Butchaiah, Aged about 62 years, Agriculture, R/o.Kyathanpally Village, Mandamarri Mandal, Mancherial District .. Petitioner And The State of Telangana, rep., by its Principal Secretary, Revenue Department, Secretariat, Hyderabad and others .. Respondents The Court made the following:

THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.27768 OF 2019 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue for the respondents. 2.

Petitioner claims to be the owner of land admeasuring Acs.2.00 in Survey No.25/1 of Kyathanpally Village, Mandamarri Mandal, Mancherial District. He further alleges that the said property was standing in the name of his father. After death of his father, petitioner succeeded to the said property. Thereafter, petitioner made application for conducting of survey through F-Line mode on 06.03.2019. Alleging inaction on the said application, this Writ Petition is filed.

3.

From a reading of the averments made in the affidavit filed in support of the Writ Petition, it appears that the name of the father of the petitioner was reflected in the revenue records, but after death of his father, petitioner's name is not mutated in the revenue records. Even before petitioner applied for mutation, he applied for conducting of survey and the same is not valid. 4.

Thus, the petitioner is granted liberty to make an application seeking mutation of his name in the revenue records and after the mutation exercise is completed and his name is entered in the revenue records, he is permitted to apply for conducting of survey of the subject property.

5.

The Writ Petition is accordingly disposed of. Pending miscellaneous petitions, if any, shall stand closed. ___________________ P.NAVEEN RAO, J Date:13.12.2019 KH
