THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 39171 of 2015 ORDER:

The grievance of the petitioner in this case was with regard to the alleged inaction on the part of the police authorities in conducting an enquiry and filing a charge sheet in relation to Crime No.37 of 2015 on the file of the Yeldurthi Police Station, Medak District. The petitioner also alleged that the fourth respondent, who was the accused in the said offence, had not been arrested.

2. Written instructions dated 15.12.2015 were furnished by the SubDivisional Police Officer, Medak Sub-Division, Medak District, stating that Crime No.37 of 2015 was registered under Sections 354 and 506 r/w provisions of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, on the file of Yeldurthi Police Station upon the complaint made by the petitioner. The fourth respondent was stated to be the sole accused in the crime who was arrested on 07.08.2015 and produced before the learned Judicial Magistrate of First Class, Medak, for remand but as per the directions of the learned Magistrate, he was issued a notice under Section 41A Cr.P.C. Upon due investigation the police authorities found that a prima facie case was established and accordingly laid a charge sheet before the learned Judicial Magistrate of First Class at Medak on 17.08.2015 which was taken on file vide P.R.C.No.38 of 2015.

3. In the light of the aforestated developments, the apprehension of the petitioner as to the alleged inaction on the part of the police authorities stands settled.

Writ petition is accordingly closed. Pending miscellaneous petitions, if any, shall also stand closed in the light of this final order. No order as to costs.
