THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.9991 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioners/Accused Nos.6 & 7 seeking bail in the event of their arrest in connection with Crime.No.244 of 2023 on the file of Golconda Police Station, Hyderabad, registered for the offences under Section 8 (c) r/w. 20 (b) (ii) (C) and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NPDS Act').

Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The case of the Golconda Police is that A-1 and two others were found in possession of ganja on 22.08.2023. The procedure was followed and they were remanded to judicial custody. During the course of investigation, the arrested accused alleged to have confessed that these petitioners were also involved in the case and the ganja seized was sold by these petitioners. Further, child in conflict with the law (CCL) was found along with A-1. The petitioners are parents of said CCL.

On instructions, learned Additional Public Prosecutor would submit that after arrest of the son of these petitioners, though search was conducted in the premises, nothing was found. 5.

Keeping in view the circumstances of the case and in the interest of investigation, these petitioners can be granted the relief of anticipatory bail, subject to following conditions:-

1) The petitioners/Accused Nos.6 & 7 are directed to surrender before the Station House Officer, Golconda Police Station, Hyderabad, on or before 19.10.2023. On such surrender, the said Station House Officer shall release the petitioners on bail, on their executing personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, petitioner No.1/Accused No.6 shall appear before the concerned Station House Officer at 10.00 A.M on every Monday for a period of eight weeks and petitioner No.2/Accused No.7 for a period of four weeks, for the purpose of investigation and thereafter, as and when required.

3) The petitioners/Accused Nos.6 & 7 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

4) Failing to assist the investigation by these petitioners, the Police are at liberty to seek cancellation of bail granted to these petitioners.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
