THE HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDY AND THE HON'BLE SRI JUSTICE M.S.K.JAISWAL WRIT PETITION No.11997 of 2016 13.04.2016 Between:

D.Murali Mohan ..Petitioner And The Union of India, represented by its Secretary, Ministry of Information and Broadcasting, New Delhi and others ..Respondents Counsel for the petitioner: Mr.T.Koteswara Rao Counsel for respondent Nos.1 to 6: Mr.B.Narayana Reddy, Assistant Solicitor General Counsel for respondent Nos.7 and 8: -- The Court made the following:

ORDER: (Per the Hon'ble Sri Justice C.V.Nagarjuna Reddy) The petitioner, who belongs to Indian Information Service, was at the relevant point of time, the Director (News), Regional News Unit of Doordarshan Kendra at Hyderabad. He filed O.A.No.736 of 2014 on the file of the Central Administrative Tribunal, Hyderabad Bench at Hyderabad - respondent No.8 (for short 'the Tribunal'), assailing Circular No.DDN/RNU/Hyderabad/2010-S/684 & A to B, dated 09.04.2012, of respondent No.2, wherein it was laid down that as per the guidelines of Directorate General of Doordarshan Kendra, Head Office can only be from programme and engineering streams.

The grievance of the petitioner was that an officer like him belonging to Indian Information Service cannot be made to report to the officers relating to programme and engineering streams, which are far inferior to the all India level services to which he belongs. This plea of the petitioner was not found favour with the Tribunal, as a result of which, it has dismissed the O.A. by the impugned order. A perusal of the cause title of the writ petition shows that the petitioner is presently the Director, Doordarshan Kendra, Guwahati. The learned counsel for the petitioner has admitted that after the filing of the O.A.

, the petitioner has been appointed as the Director, Doordarshan Kendra, Guwahati, which is an independent position and that he is not required to report to anyone else including the programme and engineering stream officers as envisaged in the aforementioned Circular, dated 09.04.2012.

In view of the above subsequent event, the grievance with which the petitioner approached the Tribunal has ceased to exist and therefore, it is unnecessary to adjudicate the writ petition on merits. For the aforementioned reasons, the Writ Petition is disposed of

as infructuous.

As a sequel to disposal of the writ petition, W.P.M.P.No.15058 of 2016 filed by the petitioner for interim relief shall stand disposed of as infructuous.
