V.Dyumani, learned Standing Counsel for the respondent-Bank, would submit that the cause in the Writ Petition does not survive as the auction held on 19.06.2017, pursuant to the auction notice dated 15.05.2017, was of no avail as no bidders came forward to purchase the subject property. Sri K.Srinivas, learned counsel for the petitioner, would submit that, as the bank intends to issue a fresh notice to put the subject property to sale, the petitioner be given liberty to approach the Debts Recovery Tribunal under Section 17 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 against the notice issued under Section 13(4) of the said Act.
