THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.27766 of 2019 O R D E R:

Petitioner asserts that he had participated in the selection of setting up of a petroleum outlet at Solipur Village (Ghanpur to Wanaparthy Road), Khilla Ghanpur Mandal, Mahabubnagar District pursuant to the advertisement dated 11.10.2014 and that one Sri A.Jagadeeshwar was emerged as successful candidate for grant of dealership, however, he had joined as Police Constable (Civil), as such, he is not eligible to be appointed as dealer. In the circumstances, the petitioner prays for issuance of directions to the respondents to consider his case for grant of retail outlet in his favour.

On instructions, learned Standing Counsel for respondent No.1 Corporation submits that respondent No.1 addressed a letter to the said Jagadeeshwar on 29.05.2018 to confirm his appointment as Police Constable and the said individual replied to the Corporation expressing his desire to take up the dealership. It may be noted that the question as to whether a person, who is appointed as a Government servant is entitled to be granted dealership or not is required to be considered by respondent No.1 in accordance with the marketing guidelines.

In those circumstances and inasmuch as the advertisement came to be issued in 2014 and five years have elapsed, the writ petition is disposed of with the direction to respondent No.1 to take

necessary steps and decide with respect to the establishment of a petroleum outlet for the notified area within a period of eight weeks from the date of receipt of a copy of this order. It is made clear that it would be open for respondent No.1 to take a decision whether they desire to establish the outlet at the notified area or not as the same would depend on the market conditions.

Miscellaneous petitions, if any, pending in this writ petition shall also stand disposed of. There shall be no order as to costs. _________________________ CHALLA KODANDA RAM, J Dt:27.12.2019 kdl
