It is stated that the petitioner filed suit for specific performance in O.S.No.144 of 2006 on the file of Junior Civil Judge, Gajuwaka in respect of house property bearing D.No.7-53 covered by plot No.120, constructed in R.No.506 Aganampudi R.H.Colony, Kondayya Valasa Village, Gajuwaka Mandal, Visakhapatnam District and said suit was decreed. On that sale deed was executed on 11-09-2009 on behalf of Judgment-debtor in favour of the petitioner by the Junior Civil Judge, Gajuwaka and when the said document was presented for registration before the 3rd respondent, who kept the document pending in P81/2009 and insisted for 'No Objection Certificate' on the ground that property covered by sale deed is government land. Hence, the writ petition is filed.

Counter is filed by 3rd respondent-Sub-Registrar stating that refusal order dated 16-09-2009 was passed by him under Section 71 of the Registration Act (for short " the Act") refusing registration of the document and also included in the list of prohibited properties for registration under Section 22-A of the Act.

In view of the same, liberty is granted to the petitioner to challenge the order dated 16-09-2009 passed under Section 71 of the Act refusing registration of the document and inclusion of property in the list of prohibited properties under Section 22-A of the Act. With the above observation, the writ petition is disposed of.
