HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY Crl.P. No.7340 OF 2018 ORDER:

This petition is filed under Section 482 Cr.P.C. to quash the order dated 10.07.2018 passed in Crl.M.P.No.48 of 2018 in C.C.No.194 of 2012 by the Judicial Magistrate of First Class, Chevella, Ranga Reddy District declining permission to prosecute the proceedings by the de facto complainant through an advocate.

The Court below accepted the contention of the petitioner, but dismissed the petition on the ground that it is only intention of the petitioner to protract the proceedings.

Learned counsel for the petitioner requested the Court that the calendar case is posted for arguments and no trial need be conducted by the de facto complainant personally by engaging any counsel etc. Therefore, the petitioner may be permitted to advance arguments by engaging counsel.

Acceding the request of learned counsel for the petitioner, the criminal petition is allowed to the limited extent of advancing arguments only in C.C.No.194 of 2012 pending on the file of Judicial Magistrate of First Class, Chevella, Ranga Reddy Distrtict. The trial Court is directed not to permit the petitioner to conduct any other proceedings except advancement of arguments.

Pending miscellaneous petitions in the petition, if any, shall stand closed.
