HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO Crl.P.No.6536 of 2015 ORDER :

This petition is filed under Section 482 of the Code of Criminal Procedure (for short, 'the CrPC') by the Petitioner-Accused to quash the proceedings in Cr.No.178 of 2015 on the file of the Station House Officer, Humayun Nagar, Hyderabad, registered for the offences punishable under Section 406 and 420 of I.P.C., on the report of the 2nd respondent.

2. Heard both sides and perused the material on record.

3. The petition is disposed of by left open other remedies in the event of police filing final report for the petitioner is the Manager of HDFC Bank, Vijayanagar colony branch as it requires to be investigated as to at least under Section 403 I.P.C. if at all there is any dishonest misappropriation or conversion of movable property to his own use if not by the bank manager, by any of the employees of the bank from the averments of the complaint of she kept some gold in the locker that she got one of the duel keys for the other only lies within the control of the bank.

4. Accordingly, the Criminal Petition is disposed of by vacating the interim stay and permitting the investigation of Cr.No.178 of 2015 on the file of the Station House Officer, Humayun Nagar, Hyderabad. Consequently, miscellaneous petitions, if any pending, in this Criminal Petition shall stand closed.
