THE HONBLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.8896 of 2009 ORDER :

Heard learned counsel for the petitioner and learned counsel for the respondent. Perused the material available on record. The present writ petition came to be filed seeking Writ of Mandamus to declare the action of the respondent in not entertaining an application made for renewal of the passport in view of pendency of Crime No.234 of 2008, as illegal and arbitrary.

By an order dated 28.04.2009, this Court directed the respondent to consider renewal of passport held by the petitioner bearing No.B0465781 issued on 20.08.2009 and pass appropriate orders within a period of four weeks from the date of receipt of a copy of this order and communicate the same to the petitioner.

When the matter is taken up, Smt D. Pramada, learned counsel for the petitioner, submitted that no cause survives for adjudication in this matter at this stage since the passport had already been renewed and it also appears that the parties to the criminal case have settled the dispute amicably. A perusal of the record would show that Criminal Petition No.548 of 2009 came to be filed by the petitioner seeking to quash Crime No.234 of 2008 registered by the Mills Colony Police, Warangal, for the offences punishable under Section 498-A IPC read with Sections 3 and 4 of the Dowry Prohibition Act. While issuing notice before admission on 28.02.2009, the Hon'ble Court granted stay for a period of four weeks. On 25.11.2009, the matter was withdrawn since the charge sheet was already filed. In view of the statement made by the petitioner, no further orders are necessary and accordingly, the writ petition is closed. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand

closed.
