ORDER
This writ petition is filed challenging the order dated 20-07-2000 passed in E.P.No.31 of 1997 in I.D.No.58 of 1989 by the Industrial Tribunal-cum-Labour Court, Anantapur and to quash or set aside the same by holding it as arbitrary and illegal.
Heard Sri A.Rama Rao, learned Standing Counsel appearing for the petitioner and Sri G.Ravi Mohan, learned counsel appearing for the 2nd respondent.
When the matter is taken up for hearing, it is noticed that the petitioner-Corporation has challenged the order dated 20-07-2000 passed in E.P.No.31 of 1997, but it has not challenged the order passed in I.D.No.58 of 1989. Unless and until, the petitioner-Corporation has challenged the order passed in I.D.No.58 of 1989, this Court cannot adjudicate the consequential order passed in E.P.No.31 of 1997. In principle, the petitioner-Corporation has to comply with the order passed in I.D.No.58 of 1989. But, it has not complied with the same. When the Corporation has not complied with the order passed in the said I.D, it cannot challenge the consequential order dated 20-07-2000 passed in
the EP. Hence, this Court is not inclined to interfere with the order passed in the E.P.
Accordingly, the Writ Petition is dismissed. No costs. Miscellaneous petitions, if any, pending shall stand closed.
