HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.32013 OF 2016 ORDER:

This writ petition is filed seeking a Writ of Mandamus declaring the action of the respondents in not considering the representation of the petitioner dated 02.07.2016 as illegal and arbitrary. 2.

Heard the learned counsel for the petitioner and the learned Government Pleader for fisheries (Andhra Pradesh) representing the respondents 1 to 3.

It is the case of the petitioner that he is the owner of an extent of Ac.0.36 cents in RS No.199/ A of Chevuru village, Mudinepalli Mandal, Krishna District. It is the further case of the petitioner that respondents 4 to 6 are having an extent of farm area of Ac.17.00 cents of land in Survey Nos.198/ 1A, 2A, 199/ 2014. A perusal of the record reveals that the respondents 4 to 6 have obtained permission for conversion of agricultural land into fresh aqua culture fish pond in the above said land in the farm area of Ac.22.00 cents. The learned counsel for the petitioner submitted that the respondents 4 to 6 have obtained permission by suppressing the material facts. A perusal of the record reveals that the petitioner submitted a representation to the second respondent on 02.07.2016. For one reason or other, the second respondent has not disposed of the representation of the petitioner.

At the time of arguments, the only relief sought by the petitioner is to direct the second respondent to dispose of the

representation of the petitioner dated 02.07.2016. The learned Government Pleader for Fisheries also consented for the same. 5.

Having regard to the facts and circumstances of the case and also in view of the submissions made by both the counsel, the second respondent is hereby directed to dispose of the representation of the petitioner dated 02.07.2016 as expeditiously as possible, preferably within a period of four weeks from the date of receipt of a copy of this order in the light of G.O.Ms.No.15 Animal Husbandry, Dairy Development and Fisheries (Fish) Department, dated 26.05.2015. No order as to costs. As a sequel, the miscellaneous petitions, pending if any in this writ petition, shall stand closed. ____________________ T.SUNIL CHOWDARY, J 21.09.2016 Rns
