HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.3528 of 2004 ORDER:

This Writ Petition is filed seeking a Writ of Mandamus declaring the order dated 22.12.2003 passed by the 1st respondent in S & E Appeal No.1/ 2000 directing the petitioners herein to pay a sum of Rs.16,880/ - as terminal benefits to the 3rd respondent as illegal and arbitrary.

On 26.02.2004, this Court while admitting the writ petition, passed the following interim order :- " Interim stay of all further proceedings subject to condition of the petitioners depositing the entire amount as per orders in S & E Appeal No.1 of 2000 dated 22.12.2003 within a period of two weeks from today. On such deposit, the 3rd respondent is at liberty to withdraw the same without furnishing any security."

Learned counsel for petitioners submits that pursuant to the interim order passed by this Court, the petitioners have deposited the entire amount as directed by the 1st respondent. In view of compliance of the interim order passed by this Court, the cause in the writ petition does not survive for adjudication and has become infructuous.

Accordingly, the writ petition is dismissed as infructuous. No order as to costs.
