HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CIVIL MISCELLANEOUS PETITION No.169 of 2013 ORDER:

This petition is filed to withdraw O.P.No.70 of 2011 from the file of Principal Senior Civil Judge, Kothagudem, Khammam District and transfer the same to Senior Civil Judge, Nizamabad for disposal in accordance with law.

According to the affidavit of petitioner, this O.P was originally filed at Nizamabad but withdrawn from Nizamabad and transferred to Kothagudem as per orders in Tr.C.M.P.No.88 of 2011 dated 13.04.2011. According to affidavit of petitioner, subsequent to transfer of this case, respondent herein shifted her residence to Nizamabad, therefore it is convenient for both parties, if the case is brought back to Nizamabad from Kothagudem.

3. Heard arguments.

4. Advocate for petitioner submitted if the case is withdrawn from Kothagudem and transferred to Nizamabad, it will convenient for the parties, as both of them are staying at Nizamabad.

5. Advocate for respondent contended that according to her instructions, respondent herein is residing at Bhadrachalam and allegation that she shifted her residence to Nizamabad is not correct.

6. I have perused the material papers filed along with the transfer petition.

Without going into the contentions and rival contentions of both parties and without going into the correctness of allegation that wife/respondent shifted her residence from Bhadrachalam to Kothagudem, I feel that this transfer O.P.No.70 of 2011 can be disposed of directing the Senior Civil Judge, Kothagudem to dispose of O.P.No.70 of 2011 pending before that

Court within a stipulated time.

Accordingly, this Transfer Miscellaneous Petition is dismissed directing the Principal Senior Civil Judge, Kothagudem to dispose of O.P.No.70 of 2011, as expeditiously, as possible, preferably, within three (03) months from the date of receipt of this order in accordance with law. No costs.

As a sequel, miscellaneous petitions, if any filed in this civil miscellaneous petition, shall stand closed.
